Fergus Falls man won't go to prison for killing father

Fergus Falls, MN (KFGO) - A Fergus Falls man who was on trial for killing his father will not be going to prison.

An Otter Tail County jury Wednesday found 29-year-old Dustin Defiel not guilty of second-degree murder by reason of mental deficiency.

Defiel shot and killed his father, Rick, on June 1, 2016.

He was originally found guilty of second-degree murder and innocent of first-degree murder but phase two of the trial was a defense action that maintained Defiel was mentally ill at the time of the shooting and didn’t comprehend what he was doing.

Defiel will now be sent to St. Peter Security Hospital where he’ll be held until mental health commitment proceedings can take place.
