Fargo Civil Service Commission denies appeal by fired police officer David Boelke

FARGO, N.D. (KFGO) - The Fargo Civil Service Commission has upheld the termination of David Boelke. The 15-year veteran of the police department appealed his firing last month for work performance that violated rules of conduct. The unanimous vote by the five member board followed a marathon hearing on his appeal last Friday. 

The commission spent most of Wednesday night's meeting discussing a request made by Boelke's attorney Mark Frieze, to drop reference to claims Boelke lied to superiors during the course of the department's internal investigation over complaints about his job performance. Several motions failed to reach an agreement on removing any mention of lying. Some commission members said earlier testimony and evidence left "reasonable doubt" that Boelke had lied. 

Frieze told KFGO News, Boelke's firing may not be a done deal. He will evaluate the civil service commission's findings and determine if Boelke will appeal the decision to the city commission or ask a district court to evaluate the findings of the civil service commission.
