FARGO (KFGO) - Opponents of the F-M Diversion Project are asking a federal judge to determine whether ongoing work in the Oxbow area violates a court order to stop construction.
In court documents, attorney Gerald Von Korff says the continuing work at Oxbow "is a major area of disagreement" with the Richland/Wilkin Joint Powers Authority.
Von Korff says the JPA is concerned that a road is being built to climb ten feet higher than required. In a letter to U.S. District Judge John Tunheim, Von Korff says the JPA is worried that Oxbow is trying to build a new levee system, rather than restoring existing protection.
Von Korff calls the continuing work at Oxbow a "flagrant waste of money" and a violation of Tunheim's order. He says the JPA is looking for the "simplest and fairest possible method" of resolving the issues.
