FARGO (KFGO) - Despite his argument he was fired from his job with the City of Fargo because he's black, city commissioners have upheld his termination,.

Aaron Cockfield appealed his firing after the Civil Service Commission denied his appeal last month. He told city commissioners that he shoved his acting supervisor, Shawn Eckre, in self-defense after the two had a heated argument and Eckre came at him.

Cockfield's attorney, Leo Wilking, said there is a record that indicates documented racial prejudice and derogatory behavior toward his client over a number of years and that Eckre provoked Cockfield.

Solid Waste Utility Manager Terry Ludlum said his investigation determined Cockfield clearly violated city policy by shoving his supervisor and his firing had nothing to do with racial bias.

In a special meeting Monday, city commissioners voted unanimously to uphold Cockfield's termination. Two commissioners were not present.

Wilking says the firing may end up in court.
