Sunflower seed label claim leads to federal lawsuit

FARGO, N.D. (KFGO) - A Wahpeton, N.D. based sunflower seed company wants a federal judge to order a recall of one of its competitor's products for allegedly misleading consumers about the amount of salt in its sunflower seeds.

Giant Snacks, Inc. filed an 18-page complaint in U.S. District Court in Fargo against Wild Dutchman Products of Mound City, S.D.  Giant says there's “no credible evidence” to prove that Wild Dutchman's "Half the salt, all the flavor" advertising and packaging claim is true.

Giant says according to test results from two independent laboratories, Wild Dutchman's claims are "literally false and deceptive." The company says “consumers have formed, or will likely form the mistaken belief that Wild Dutchman sunflower seeds have half the salt, or less of Giant sunflower seeds.”

Giant claims that Wild Dutchman’s statement has led to "economic injury" to its reputation and sales. Giant is asking for a recall on the disputed products, along with damages to be determined during a trial.

Wild Dutchman did not immediately respond to a request for comment.
